ยินดีต้อนรับสู่ https://www.solvil-et-titus.co.th. เว็บไซต์นี้ดำเนินการโดยบริษัท ซิตี้เชน (ประเทศไทย) จำกัด ภายใต้การได้รับอนุญาตจาก Solvil et Titus SA เราให้บริการแก่ท่านโดยยึดถือเงื่อนไขในการใช้งานดังต่อไปนี้อย่างเคร่งครัด ดังนั้น ขอให้ท่านโปรดอ่านเงื่อนไขในการใช้งานทั้งหมดโดยละเอียด โดยการเข้าใช้งานเว็บไซต์นี้ถือว่า ท่านได้ยอมรับและเข้าใจเงื่อนไขในการใช้งานแล้ว ทั้งนี้ เราอาจแก้ไขเปลี่ยนแปลงเงื่อนไขในการใช้งาน รวมถึงกฎ และนโยบายอื่น ๆ ที่เกี่ยวข้องกับเงื่อนไขในการใช้งานเว็บไซต์นี้โดยไม่ต้องแจ้งให้ทราบล่วงหน้า การที่ท่านเข้าใช้งานเว็บไซต์นี้โดยต่อเนื่องจะถือว่าท่านได้ยอมรับเงื่อนไขในการใช้งานที่มีการเปลี่ยนแปลงแล้ว

1) คำนิยาม

คำหรือข้อความดังต่อไปนี้ให้มีความหมายดังที่กำหนดไว้ด้านล่างนี้

ก. “บริษัทในเครือ” หมายถึงบริษัทที่มีความเกี่ยวข้องกับเรา บริษัทอื่นที่เป็นบริษัทย่อยของเราไม่ว่าโดยทางตรงหรือทางอ้อม หรือ บริษัทที่ประกอบธุรกิจโดยการถือหุ้นของเราไม่ว่าโดยทางตรงหรือทางอ้อม หรือ บริษัทย่อยไม่ว่าโดยทางตรงหรือทางอ้อมของบริษัทซึ่งเป็นบริษัทที่ประกอบธุรกิจโดยการถือหุ้นของเราไม่ว่าโดยทางตรงหรือทางอ้อม

ข. “หุ้นส่วนทางธุรกิจ” หมายถึง

(1) บุคคลหรือนิติบุคคลที่เข้าทำข้อตกลงกับเราเพื่อประชาสัมพันธ์การให้บริการและเว็บไซต์แห่งนี้ รวมถึงจัดหาผู้เข้าเยี่ยมชมและเข้ามาใช้บริการเว็บไซต์นี้

(2) บุคคลหรือนิติบุคคลที่เข้าทำข้อตกลงกับเราเพื่อประชาสัมพันธ์การให้บริการและเว็บไซต์นี้ผ่านบนเว็บไซต์ของบุคคลดังกล่าว และ

(3) บริษัทในเครือของเรา

ค. “ประเทศไทย” หมายถึง ราชอาณาจักรไทย

ง. “ทรัพย์สินทางปัญญา” หมายถึง ลิขสิทธิ์ สิทธิการออกแบบ สิทธิบัตร เครื่องหมายการค้า ความลับทางการค้า องค์ความรู้ “รูปลักษณ์และความรู้สึก” และเนื้อหาในเว็บไซต์นี้ (ทั้งภาพและเสียง) รวมถึงทรัพย์สินทางปัญญาอื่นๆ (ทั้งที่ได้จดทะเบียนแล้วและยังไม่ได้จดทะเบียน) คำขอเพื่อการได้มาซึ่งสิทธิดังกล่าว และสิทธิอื่นใดไม่ว่าในลักษณะก็ตามในทำนองเดียวกัน ไม่ว่าจะได้จดทะเบียนในประเทศใดก็ตาม

จ. “ราคาสุทธิต่อหน่วย” หมายถึง ราคาขายของสินค้าต่อหน่วยหลังจากที่ได้รับจัดสรรส่วนลด (หากมี) และหักส่วนลด รายการส่งเสริมการขาย หรือ ส่วนลดราคาอื่นๆ ที่เราได้นำเสนอต่อท่าน

ฉ. “คำสั่งซื้อ” หมายถึง การที่ท่านสั่งซื้อสินค้าและเราได้จัดสรรหมายเลขการสั่งซื้อให้ท่าน

ช. “ข้อมูลส่วนบุคคล” หมายถึง ข้อมูลใดก็ตามที่บ่งชี้หรือสามารถบ่งชี้ตัวบุคคลได้ (เช่น ชื่อ หมายเลขโทรศัพท์ อีเมล์ ที่อยู่ เพศ วันเกิด ฯลฯ)

ซ. “สินค้า” หมายถึง สินค้าที่ท่านสามารถสั่งซื้อได้ในเว็บไซต์นี้

ฌ. “ราคาขาย” หมายถึง ราคาของสินค้าแต่ละรายการตามที่ได้ระบุไว้ในเว็บไซต์

ญ. “ข้อมูลที่ใช้ในการสมัคร” หมายถึง ข้อมูลที่ท่านได้ให้เราไว้เมื่อเข้าใช้บริการ

ฎ. “การบริการ” หมายถึง การให้บริการแก่ท่านในเว็บไซต์นี้และการให้บริการเสริมอื่นๆ เช่น บริการหลังการขาย กระบวนการชำระเงินและการจัดส่ง

ฏ. “ร้านค้า” หมายถึง ร้านค้าที่ขายสินค้าปลีกหรือร้านค้าที่ดำเนินกิจการโดยบริษัทในเครือของเรา รวมถึงผู้ที่ได้รับอนุญาตให้เป็นตัวแทนจำหน่ายสินค้าปลีกของเรา

ฐ. “เรา” หมายถึง บริษัท ซิตี้เชน (ประเทศไทย) จำกัด รวมถึงผู้รับโอนสิทธิที่ได้รับอนุญาต

ฑ. “เว็บไซต์” หมายถึง เว็บไซต์ของเรา ซึ่งที่อยู่คือ https://www.solvil-et-titus.co.th และ

ฒ. “ท่าน” หมายถึง ท่าน

การใช้คำนิยามที่เป็นพหูพจน์หมายรวมถึงกรณีที่เป็นเอกพจน์ และคำนิยามที่เป็นเอกพจน์ให้หมายรวมถึงกรณีที่เป็นพหูพจน์ด้วย

2) ราคาและส่วนลด

ราคาที่ระบุไว้เป็นราคาที่ใช้ในการสั่งซื้อผ่านเว็บไซต์นี้เท่านั้น ส่วนลดหรือรายการส่งเสริมการขายอื่นที่ไม่ได้จัดไว้ให้ผ่านเว็บไซต์นี้จะไม่สามารถนำมาใช้ในการสั่งซื้อได้

เราอาจเปลี่ยนแปลงราคาในเว็บไซต์นี้ได้ตลอดเวลาโดยไม่ต้องแจ้งให้ทราบล่วงหน้า

3) การใช้ในเชิงบุคคล

สินค้าที่เสนอขายผ่านเว็บไซต์นี้เพื่อให้ท่านนำไปใช้ในเชิงบุคคลเท่านั้น ข้อเท็จจริงและข้อมูลที่ปรากฏในเว็บไซต์นี้ก็เป็นไปเพื่อการใช้ในเชิงบุคคลเท่านั้น ไม่อนุญาตให้นำไปใช้ในการขายซ้ำหรือใช้ในเชิงพาณิชย์

4) เมื่อเรารับคำสั่งซื้อของท่าน

เราขอสงวนสิทธิไม่รับคำสั่งซื้อสินค้าหรือบริการ เมื่อท่านได้ลงทะเบียนและดำเนินการตามกระบวนการสั่งซื้อจนสำเร็จลุล่วง หมายความว่าท่านได้ทำคำเสนอซื้อสินค้าของเราแล้ว เราจะส่งอีเมล์รับรู้คำสั่งซื้อให้แก่ท่านเพื่อยืนยันการรับรู้คำสั่งซื้อ อย่างไรก็ดี ขั้นตอนนี้ไม่ใช่การรับคำสั่งซื้อ เราจะทำการแจ้งการจัดส่งสินค้าตามคำสั่งซื้อเมื่อเราได้ตรวจสอบจำนวนสินค้าที่มีอยู่และความพร้อมของบริการขนส่งแล้วเท่านั้น

5) กรรมสิทธิ์และความเสี่ยงภัยในการสูญหาย

ท่านเป็นเจ้าของกรรมสิทธิ์และผู้รับความเสี่ยงภัยในการสูญหายของสินค้าที่สั่งซื้อตั้งแต่ที่ได้มีการจัดส่งสินค้าให้กับผู้ให้บริการขนส่ง

6) ทรัพย์สินทางปัญญา

ท่านได้รับรู้และเข้าใจว่าเราเป็นเจ้าของหรือได้รับอนุญาตโดยบุคคลภายนอกให้เรานำทรัพย์สินทางปัญญามาใช้ในงานเป็นส่วนหนึ่งของการบริการหรือการบริการเสริม เราขอสงวนสิทธิในทรัพย์สินทางปัญญาทั้งหมดที่ปรากฏในการบริการ รวมถึงแต่ไม่จำกัดเพียงเนื้อหาในเว็บไซต์นี้และในโดเมนชื่อ https://www.solvil-et-titus.co.th. การใช้บริการของท่านไม่ส่งผลให้ท่านมีสิทธิอ้างความเป็นเจ้าของในทรัพย์สินทางปัญญาที่ปรากฏในการบริการหรือบนเว็บไซต์นี้

7) คุกกี้ (Cookies)

ก. เราอาจได้รับข้อมูลเกี่ยวกับคอมพิวเตอร์ของท่าน รวมถึงเลขรหัสการเชื่อมต่ออินเตอร์เน็ต (IP address) ระบบปฏิบัติการ ประเภทของช่องทางเข้าใช้เว็บไซต์ (browser) เพื่อใช้ในการบริหารระบบและวิเคราะห์สถิติ ทั้งนี้ เป็นไปเพื่อเก็บข้อมูลสถิติของท่านเกี่ยวกับการเข้าชมเว็บไซต์ของเรา

8) ข้อมูลสินค้า

สินค้าที่แสดงในเว็บไซต์นี้อาจพร้อมหรือไม่พร้อมให้บริการแก่ท่าน ณ ร้านค้าปลีกที่ดำเนินการโดยบริษัทในเครือของเรา ทางเราไม่ขอรับรองหรือรับประกันว่าสินค้าใดๆ หรือบริการต่างๆ ที่แสดงบนเว็บไซต์นี้ จะพร้อมให้บริการแก่ท่านไม่ว่าในเวลาหรือสถานที่ใด ราคาที่แสดงบนเว็บไซต์ทั้งหมดเป็นสกุลเงินบาท

9) หุ้นส่วนทางธุรกิจ

หุ้นส่วนทางธุรกิจที่ร่วมงานกับเราในการจัดหาและประชาสัมพันธ์การบริการ ได้แก่ บริษัท บริษัท ทูซีทูพี (ประเทศไทย) จำกัด (“ทูซีทูพี”) บริษัท เคอรี่ เอ็กซ์เพรส (ประเทศไทย) จำกัด (“เคอรี่ เอ็กซ์เพรส”) และบริษัทประกันภัยและการขนส่งต่างๆ กรุณาอ่านข้อตกลงและเงื่อนไขในเรื่องการให้บริการชำระเงินและบริการขนส่ง ซึ่งให้บริการโดยทูซีทูพี และเคอรี่ เอ็กซ์เพรส ตามลำดับ รวมถึงนโยบายความปลอดภัยของทั้งสองบริษัทก่อนท่านมีคำสั่งซื้อ เมื่อท่านทำคำสั่งซื้อ จะถือว่าท่านได้ยอมรับเงื่อนไขและข้อกำหนด และนโยบายความเป็นส่วนตัวของหุ้นส่วนทางธุรกิจเป็นที่เรียบร้อยแล้ว

10) ผู้เยาว์

บุคคลใดมีอายุต่ำกว่า 20 ปี ควรเข้าใช้เว็บไซต์ของเราภายใต้การชี้นำของบุพการีหรือผู้ปกครอง

11) ไม่มีตัวแทน

หุ้นส่วนทางธุรกิจของเราเป็นผู้เข้าทำสัญญาที่กระทำการโดยอิสระ และไม่ได้กระทำลงในฐานะตัวแทน ลูกจ้าง ผู้แทนของเรา หรือฐานะอื่นใดในทำนองเดียวกัน

12) การส่งสารจากท่าน

สารหรือเนื้อหาใดที่ท่านส่งเข้ามาที่เว็บไซต์นี้ทางอีเมล์หรือช่องทางอื่น รวมถึงข้อมูลใดๆ คำถาม ความคิดเห็น ข้อเสนอแนะ หรือสิ่งอื่นในทำนองเดียวกัน จัดเป็นสิ่งที่ไม่ใช่ความลับและไม่มีความเป็นเจ้าของ สิ่งใดที่ท่านส่งเข้าเว็บไซต์จะกลายเป็นทรัพย์สินของบริษัท ซิตี้เชน (ประเทศไทย) จำกัด และอาจถูกนำไปใช้เพื่อจุดประสงค์ต่างๆ ซึ่งรวมถึงแต่ไม่จำกัดเพียงการทำซ้ำ เปิดเผย ส่งต่อ ตีพิมพ์ ออกอากาศ และประกาศ เราถือว่าเรามีสิทธิใช้ความคิด แนวคิด องค์ความรู้ หรือเทคนิค ซึ่งปรากฏอยู่ในสารต่างๆ ที่ท่านส่งเข้ามาที่เว็บไซต์นี้ โดยมีวัตถุประสงค์ต่างๆ ซึ่งรวมถึงแต่ไม่จำกัดเพียงการพัฒนา การผลิต หรือการทำการตลาดสินค้าด้วยการใช้ข้อมูลดังกล่าว ในกรณีข้อมูลส่วนบุคคลที่เราเก็บ จะถูกจัดเก็บเป็นความลับและดำเนินการตามนโยบายความเป็นส่วนตัวของเรา

13) การยกเว้นข้อรับรองและการรับประกัน

เราจะใช้ความพยายามตามความเหมาะสมในทางการค้าในการรวบรวมข้อมูลที่ถูกต้องและเป็นปัจจุบันลงบนเว็บไซต์นี้ แต่เราไม่ขอรับรองและรับประกันความถูกต้องดังกล่าว บริษัท ซิตี้เชน (ประเทศไทย) จำกัด บริษัทในเครือ หรือฝ่ายอื่นๆ ที่มีส่วนเกี่ยวข้องในการสร้างสรรค์ ผลิต หรือนำเสนอเว็บไซต์นี้ จะไม่รับผิดชอบต่อความเสียหาย ความสูญเสีย ต้นทุนและค่าใช้จ่ายที่เกิดขึ้น หรือเป็นผลมาจากการที่ท่านเข้าถึงหรือเข้าใช้งานเว็บไซต์นี้ ไม่ว่าจะเกิดขึ้นโดยตรง โดยอ้อม เป็นกรณีเฉพาะ กรณีทั่วไป หรือเป็นผลสืบเนื่องจากการกระทำนั้น สิ่งที่ปรากฏทั้งหมดบนเว็บไซต์นี้เป็นการนำเสนอแก่ท่านตามความเป็นจริงโดยไม่มีการรับประกันใดๆ ทั้งสิ้นไม่ว่าโดยชัดแจ้งหรือโดยนัย รวมถึงการรับประกันในด้านสภาพการใช้ประโยชน์ในเชิงพาณิชย์ และความเหมาะสมสำหรับวัตถุประสงค์เฉพาะ

เราไม่รับประกันว่า การทำงานของเว็บไซต์นี้จะไม่เกิดข้อผิดพลาด หรือข้อผิดพลาดที่เกิดขึ้นในเว็บไซต์นี้จะได้รับการแก้ไข หรือเว็บไซต์นี้หรือผู้ให้บริการเซิร์ฟเวอร์ (server) จะปราศจากโปรแกรมที่เป็นภัย (malware) หรือจะไม่ถูกแทรกแซงการทำงานด้วยปัญหาทางเทคนิค หรือจะไม่ถูกจารกรรมข้อมูล (hack-free)

เราไม่มีส่วนรับผิดชอบในเนื้อหาของเว็บไซต์อื่นๆ ที่เชื่อมต่อมายังเว็บไซต์ของเรา หรือการเสนอให้บริการใดๆ ของเว็บไซต์ที่เชื่อมต่อ และเราไม่รับผิดชอบ ไม่ให้การรับรอง รับประกัน หรือดำเนินการแทนเว็บไซต์ที่เชื่อมต่อนั้นๆ

เราไม่มีส่วนรับผิดชอบในการกระทำใดๆ ของหุ้นส่วนทางธุรกิจ (รวมถึงบุคคลหรือนิติบุคคลที่หุ้นส่วนทางธุรกิจของเราได้ทำข้อตกลงเพื่อให้บริการแก่ท่าน (“บริษัทในเครือของหุ้นส่วนทางธุรกิจ”) และเราไม่รับรองและไม่รับประกันในบริการที่พวกเขาจัดเตรียมให้แก่ท่านเกี่ยวกับการใช้บริการเว็บไซต์นี้ บริการ หรือการสั่งซื้อสินค้า

14) ขอบเขตความรับผิด

ก. ขอบเขตความรับผิดสูงสุดไม่เกินกว่าที่กฎหมายกำหนดไว้ ตลอดจนสงวนและจำกัดเพียงแค่นโยบายการคืนสินค้าในข้อ 7 นโยบายการเปลี่ยนสินค้าในข้อ 8 และการรับประกันทั่วโลกตามที่กำหนดไว้ในข้อ 9 เราขอปฏิเสธการรับรองหรือรับประกันทั้งหมดในส่วนของสินค้าและบริการของเรา ไม่ว่าจะกำหนดไว้โดยชัดแจ้งหรือโดยนัย

ข. เราจะไม่รับผิดชอบต่อท่าน หรือบุคคลที่สามในเรื่องของสัญญา การละเมิด หรือการเรียกร้องความเสียหายใดๆ ความรับผิด ความสูญเสีย ความเสียหาย ต้นทุนและค่าใช้จ่ายซึ่งเกิดจากหรือเกี่ยวข้องกับการใช้งานเว็บไซต์ของท่านหรือการทำงานของเว็บไซต์นี้ (รวมถึงแต่ไม่จำกัดเพียงการแทรกแซง การเข้ามาของโปรแกรมที่เป็นภัย (malware) การจารกรรมข้อมูล (hack) ความไม่ถูกต้อง ข้อผิดพลาดหรือการละเลยใดๆ) หรือข้อกำหนดในเรื่องสินค้าหรือบริการโดยไม่คำนึงถึงต้นเหตุ และเราไม่ต้องรับผิดต่อการเรียกร้องค่าเสียหาย ความรับผิด ความสูญเสีย ความเสียหาย ต้นทุนและค่าใช้จ่ายที่เกิดขึ้นจากเหตุนั้นๆ

ค. เราจะไม่รับผิดต่อท่านหรือบุคคลที่สามในเรื่องของสัญญา การละเมิด หรือการเรียกร้องความเสียหายใดๆ ความรับผิด ความสูญเสีย ความเสียหาย ต้นทุนและค่าใช้จ่ายซึ่งเกิดจากหรือเกี่ยวข้องกับการให้บริการแก่ท่านโดยหุ้นส่วนทางธุรกิจ และ/หรือบริษัทในเครือของหุ้นส่วนทางธุรกิจ ซึ่งเกี่ยวข้องกับการที่ท่านใช้งานเว็บไซต์นี้ การบริการ หรือสินค้าโดยไม่คำนึงถึงต้นเหตุ และเราไม่ยอมรับการเรียกร้องค่าเสียหาย ความรับผิด ความสูญเสีย ความเสียหาย ต้นทุนและค่าใช้จ่ายที่เกิดขึ้นจากเหตุนั้นๆ

ง. แม้ว่าจะมีข้อกำหนดอื่นๆ ที่แตกต่างจากเงื่อนไขในการใช้งานนี้ ความรับผิดรวมสูงสุดของเราต่อท่าน หรือต่อบุคคลที่สามในเรื่องสัญญา การละเมิด หรือการเรียกร้องความเสียหายใดๆ ความรับผิด ความสูญเสีย ความเสียหาย ต้นทุนและค่าใช้จ่ายซึ่งเกิดจากหรือเกี่ยวข้องกับการที่ท่านใช้งานเว็บไซต์นี้ การบริการ และการขายสินค้าให้ท่าน จะต้องไม่เกินจำนวนรวมที่ท่านได้จ่ายไปตามคำสั่งซื้อสินค้า แต่เราไม่ต้องรับผิดต่อท่านในกรณีของการเสียกำไร ข้อตกลงทางธุรกิจ การค้าขาย หรือความเสียหายหรือสูญเสียในลักษณะใดก็ตาม ไม่ว่าจะเป็นกรณีเฉพาะ กรณีทั่วไป โดยทางอ้อม หรือเป็นผลสืบเนื่องจากการกระทำนั้น

15) การชดใช้ค่าเสียหาย

ท่านตกลงชดใช้ค่าเสียหาย โต้แย้ง และป้องกันเรา เจ้าหน้าที่ กรรมการ ลูกจ้าง ตัวแทน และผู้ผลิตสินค้าของเรา ให้ปลอดจากข้อเรียกร้อง ความรับผิด ความสูญเสีย ความเสียหาย ต้นทุนและค่าใช้จ่าย ไม่ว่าจะในลักษณะใดก็ตาม รวมถึงแต่ไม่จำกัดเพียง ความสูญเสียและความเสียหาย ไม่ว่าจะเป็น โดยทางอ้อม กรณีเฉพาะ โดยบังเอิญ และ/หรือเป็นผลสืบเนื่องจากการกระทำนั้น และค่าธรรมเนียมต่างๆ ตามกฎหมาย ซึ่งเกิดจากหรือเกี่ยวกับการผิดเงื่อนไขในการใช้งานข้อหนึ่งข้อใดของท่าน หรือความรับผิดอื่นๆ ที่เกิดจากหรือเกี่ยวกับการใช้งานเว็บไซต์นี้หรือการใช้บริการของท่าน หรือกรณีที่บุคคลอื่นเข้าใช้เว็บไซต์นี้โดยการใช้บัญชีซื้อขายของท่าน และ/หรือ ข้อมูลส่วนบุคคลของท่าน

16) การรับรองและหน้าที่ของลูกค้า

ท่านรับรองและรับประกันต่อเราว่า (1) ท่านมีอำนาจและความสามารถตามกฎหมายในการตกลงตามเงื่อนไขในการใช้งานนี้ (2) ข้อมูลส่วนตัวที่ท่านต้องให้เราในขณะลงทะเบียนเป็นลูกค้าเป็นความจริง ถูกต้อง เป็นปัจจุบัน และสมบูรณ์ทุกประการ (3) ท่านจะแจ้งให้เราทราบทันทีเมื่อข้อมูลส่วนตัวของท่านมีการเปลี่ยนแปลง โดยติดต่อฝ่ายบริการลูกค้าที่ cs@solvil-et-titus.co.th (4) ท่านจะปฏิบัติตามสัญญา กฎหมาย ข้อกำหนด ระเบียบและข้อบังคับที่เกี่ยวข้องกับการใช้บริการ (5) ท่านจะไม่นำมัลแวร์เข้ามาที่เว็บไซต์นี้ และ (6) ท่านจะไม่นำสิ่งที่ผิดกฎหมาย ทำให้เสื่อมเสียชื่อเสียง ไม่เหมาะสม อนาจาร หรือเหยียดหยามไม่ว่าในลักษณะใดก็ตาม เข้ามาในเว็บไซต์นี้ ท่านตกลงที่จะไม่ปลอมเป็นบุคคลอื่น หรือนิติบุคคลใด หรือใช้ชื่อปลอม หรือชื่อที่่ท่านไม่มีสิทธิใช้ ท่านตกลงที่จะแจ้งให้เราทราบเมื่อเกิดกรณีอันชัดแจ้งหรือเป็นที่สงสัยว่ามีการใช้ชื่อผู้เข้าใช้งานและรหัสผ่านอย่างไม่ถูกต้อง ท่านตกลงว่าเราอาจปฏิเสธการเข้าถึงบริการได้ หากเราทราบหรือมีเหตุอันควรสงสัยว่าชื่อผู้เข้าใช้งานและรหัสผ่านของท่านถูกใช้งานอย่างไม่ถูกต้อง

17) สิ่งที่อยู่เหนือการควบคุมของเรา (เหตุสุดวิสัย)

ก. เราไม่มีส่วนรับผิดชอบต่อท่านในการละเมิด ข้อขัดข้อง หรือความล่าช้าในการปฏิบัติตามหน้าที่ให้บริการของเราที่เกิดจากเหตุการณ์ใดที่อยู่เหนือการควบคุมอย่างเหมาะสมของเรา ซึ่งรวมถึงแต่ไม่จำกัดเพียง

(1) การประท้วง การปิดงาน หรือธุรกรรมทางอุตสาหกรรมอื่น ๆ

(2) ความไม่สงบภายในประเทศ การจลาจล การบุกรุก การจู่โจมโดยผู้ก่อการร้าย หรือการขู่ว่าจะมีการก่อการร้าย สงคราม (ไม่ว่าจะมีการประกาศหรือไม่ก็ตาม) หรือการขู่ว่าจะมีหรือเตรียมการเพื่อทำสงคราม

(3) ไฟไหม้ ระเบิด พายุ น้ำท่วม แผ่นดินไหว แผ่นดินทรุด การแพร่ระบาดของโรคหรือภัยธรรมชาติอื่นๆ

(4) เมื่อไม่สามารถใช้งานรถไฟ ระบบขนส่ง อากาศยาน การขนส่งทางรถยนต์ หรือการขนส่งสาธารณะหรือขนส่งส่วนบุคคลได้

(5) เมื่อไม่สามารถใช้งานเครือข่ายโทรคมนาคมสาธารณะหรือส่วนบุคคลได้

(6) พระราชบัญญัติ พระราชกฤษฎีกา บทกฎหมาย ข้อบังคับหรือข้อห้ามของรัฐบาลใดๆ การประท้วง ความล้มเหลวหรืออุบัติเหตุที่เกี่ยวกับการขนส่ง การจัดส่งไปรษณีย์หรือการขนส่งรูปแบบอื่น ๆ

(7) ความล้มเหลวของเครือข่ายอินเตอร์เน็ตหรือเครือข่ายโทรคมนาคมอื่นใด ความล้มเหลวของผู้ให้บริการที่อยู่เว็บไซต์ของเรา การโจมตีโดยแฮ็กเกอร์ การโจมตีเพื่อให้ระบบหยุดการให้บริการ การใช้ไวรัสหรือซอฟต์แวร์ที่ประสงค์ร้ายอื่นใดเข้าโจมตี หรือการติดเชื้อไวรัส หรือการที่ระบบจ่ายพลังงานล้มเหลวหรือความล้มเหลวของเครือข่ายหรือระบบปฏิบัติการคอมพิวเตอร์ของท่าน

ข. ในสถานการณ์ที่เหตุสุดวิสัยนั้นเกิดขึ้นยาวนานกว่า 1 สัปดาห์ ท่านหรือเราสามารถยกเลิกคำสั่งซื้อได้โดยแจ้งเป็นลายลักษณ์อักษร และไม่มีส่วนต้องรับผิดชอบใด ๆ นอกจากการคืนเงินค่าสินค้าที่ท่านได้ชำระแล้วแต่ไม่ได้รับสินค้า

ค. หากเราได้ทำสัญญาจัดหาสินค้าชนิดเดียวกันหรือที่มีลักษณะคล้ายกันให้แก่ลูกค้ามากกว่า 1 ท่านและไม่สามารถจัดหาสินค้าให้แก่ท่านได้ครบถ้วนตามหน้าที่ของเราเนื่องจากมีเหตุสุดวิสัย เราอาจตัดสินใจโดยใช้ดุลยพินิจของเราแต่เพียงผู้เดียวในการเลือกดำเนินการส่งสินค้าและเลือกจำนวนสินค้าที่จะจัดส่ง

ง. เราขอสงวนสิทธิในการใช้ดุลยพินิจแต่เพียงผู้เดียวในการเลือกวิธีดำเนินการเพื่อให้สามารถกระทำตามหน้าที่ของเราได้อย่างครบถ้วนตามคำสั่งซื้อแต่ละรายการ แม้ว่าจะมีเหตุสุดวิสัยเกิดขึ้น

18) การยกเลิก

เราอาจยกเลิกการลงทะเบียน หรือการเข้าถึงเว็บไซต์นี้ของท่านโดยให้มีผลในทันที หากท่านละเมิดเงื่อนไขในการใช้งานนี้ ทั้งนี้ สิทธิใดที่มีอยู่ก่อนวันที่มีการยกเลิก ให้มีผลบังคับใช้ได้ต่อไปภายหลังการยกเลิก

19) กฎหมายที่ใช้บังคับ

การเข้าใช้งานเว็บไซต์นี้และข้อพิพาทใดที่อาจเกิดขึ้นระหว่างท่านกับเราบนเว็บไซต์นี้อยู่ภายใต้บังคับของกฎหมายไทยโดยไม่คำนึงถึงหลักการการขัดกันแห่งกฎหมาย

20) เขตอำนาจศาล

ข้อพิพาทใดเกิดขึ้นหรือเกี่ยวเนื่องจากการที่ท่านเข้าเยี่ยมชมเว็บไซต์นี้ การบริการหรือสินค้าที่ท่านสั่งซื้อ ข้อพิพาทนั้นตกอยู่ภายใต้เขตอำนาจแห่งศาลไทย ซึ่งมิใช่ศาลที่มีเขตอำนาจแต่เพียงผู้เดียว

21) ภาษา

ในกรณีที่เงื่อนไขในการใช้งานฉบับภาษาไทยและภาษาอังกฤษมีเนื้อหาขัดแย้งกัน ให้ยึดถือเงื่อนไขในการใช้งานฉบับภาษาอังกฤษเป็นหลัก

2. กระบวนการสั่งซื้อ

เลือกสินค้าและตรวจสอบรายละเอียดสินค้า

เลือกสินค้าที่ท่านต้องการสั่งซื้อโดยกดปุ่ม “เพิ่มลงรถเข็น”

หลังจากเพิ่มรายการสินค้าลงใน “รถเข็น” แล้ว ท่านสามารถกดที่ปุ่ม “ดูรายการในรถเข็น” ซึ่งจะนำท่านไปยังหน้า “รถเข็น” เพื่อตรวจสอบรายละเอียดสินค้าและเลือกสีของสินค้า นอกจากนี้ อาจมีการแนะนำสินค้าที่มีลักษณะใกล้เคียงกับสินค้าที่ท่านเลือกด้วย

2) เลือกสินค้าลงรถเข็น

สินค้าที่ท่านต้องการซื้อ จำนวนสินค้า ค่าธรรมเนียมการจัดส่งและจำนวนเงินที่ต้องชำระ ฯลฯ จะปรากฏในหน้ารถเข็นของท่าน ท่านสามารถปรับเปลี่ยนรายการสินค้าหรือจำนวนที่ต้องการสั่งซื้อได้ในหน้านี้

3) การลงทะเบียน

ท่านสามารถลงทะเบียนเข้าเป็นสมาชิกเพื่อรับสิทธิประโยชน์ที่มีให้แก่สมาชิกเท่านั้นได้ เช่น ส่วนลดในโอกาสต่าง ๆ และท่านสามารถตรวจสอบประวัติการสั่งซื้อในเว็บไซต์นี้ได้ หากท่านต้องการลงทะเบียนเข้าเป็นสมาชิก โปรดกรอกข้อมูลในแบบฟอร์มลงทะเบียน ทั้งนี้ ท่านสามารถทำการสั่งซื้อได้แม้ว่าจะไม่ได้ลงทะเบียนเป็นสมาชิกเว็บไซต์

4) รายละเอียดการสั่งซื้อ

ข้อมูลสินค้าที่ท่านเลือก จำนวน ค่าธรรมเนียมในการจัดส่ง จำนวนเงินที่ต้องชำระและข้อความที่ต้องการให้สลัก (หากมี) จะปรากฏรายละเอียดในหน้ารายละเอียดการสั่งซื้อ

ภายหลังจากท่านตรวจสอบรายละเอียดคำสั่งซื้อเรียบร้อยแล้ว โปรดกรอกข้อมูลในการจัดส่งและการเรียกชำระเงิน เมื่อท่านกรอกข้อมูลทั้งหมดครบถ้วนแล้ว ท่านสามารถดำเนินการชำระเงินได้โดยกดที่ปุ่ม “การชำระเงินกับทูซีทูพี” ท่านจะถูกนำไปยังหน้าเว็บไซต์ของทูซีทูพีเพื่อดำเนินการตามกระบวนการชำระเงินให้เสร็จสิ้น

6) ใบกำกับภาษี

ภายหลังจากท่านได้ดำเนินการตามกระบวนการชำระเงินจนเสร็จสิ้นแล้ว ท่านจะย้อนกลับมายังหน้าเว็บไซต์ของเราเพื่อยืนยันข้อมูลในใบกำกับภาษีสำหรับคำสั่งซื้อของท่าน ท่านสามารถตรวจสอบรายละเอียดคำสั่งซื้อ หมายเลขคำสั่งซื้อ จำนวนเงินที่ต้องชำระและช่องทางการชำระเงินได้ และท่านจะได้รับการยืนยันคำสั่งซื้อจากเราผ่านทางอีเมล์ สำหรับรายละเอียดเกี่ยวกับการจัดส่งสินค้า โปรดดูรายละเอียดในหัวข้อบริการจัดส่งเพิ่มเติม

เมื่อท่านชำระเงินจนเสร็จสิ้นแล้ว ท่านไม่สามารถยกเลิกคำสั่งซื้อได้

7) การยืนยันคำสั่งซื้อ

เมื่อคำสั่งซื้อของท่านได้รับการยืนยันแล้ว ท่านจะได้รับอีเมล์ระบุรายละเอียดคำสั่งซื้อของท่านและเมื่อสินค้าเข้าสู่กระบวนการจัดส่ง ท่านจะได้รับรายละเอียดในการเข้าถึงช่องทางการติดตามการจัดส่งสินค้า (เคอรี่ เอ็กซ์เพรส) ท่านอาจติดตามกระบวนการจัดส่งสินค้าของท่านได้โดยผ่านช่องทางการติดตามการจัดส่งสินค้าดังกล่าว

8) การยกเลิกคำสั่งซื้อ

คำสั่งซื้อของท่านไม่สามารถยกเลิกได้เมื่อกระบวนการชำระเงินเสร็จสมบูรณ์แล้ว ท่านอาจขอคืนหรือขอเปลี่ยนสินค้าได้โดยดำเนินการตามเงื่อนไขและข้อกำหนดในข้อ 7 นโยบายการคืนสินค้า หรือข้อ 8 นโยบายการเปลี่ยนสินค้า

3. นโยบายไม่ส่งออกสินค้า

เราไม่มีนโยบายจำหน่ายสินค้าบนเว็บไซต์นี้ให้แก่ลูกค้าที่อาศัยอยู่นอกประเทศไทย

4. การประกันภัย

การประกันภัยครอบคลุมถึงราคาสุทธิต่อหน่วยของสินค้าแต่ละประเภทและท่านจะได้รับเงินคืนหากสินค้าสูญหายหรือเสียหายระหว่างการจัดส่ง ทั้งนี้ การประกันภัยไม่ครอบคลุมถึงกรณีที่การจัดส่งหรือขนส่งสินค้าล่าช้า

1. ระยะเวลาในการจัดส่ง

คำสั่งซื้อทั้งหมดที่เราได้รับไว้แล้วจะถูกดำเนินการภายใน 2 วันทำการ นับตั้งแต่วันที่รับคำสั่งซื้อ ภายหลังได้รับการยืนยันคำสั่งซื้อแล้ว ลูกค้าจะได้รับสินค้าภายใน 3-4 วันทำการ ทั้งนี้ ขึ้นอยู่กับจุดหมายปลายทางแต่ละแห่ง โปรดเข้าใจว่าระยะเวลาในการจัดส่งดังข้างต้นไม่ใช่การรับประกันระยะเวลาจริงที่ใช้ในการจัดส่ง

เราไม่มีส่วนรับผิดชอบในกรณีที่สินค้าเกิดความเสียหาย ชำรุด หรือสูญหาย หรือการจัดส่งล่าช้า จัดส่งผิด หรือไม่ได้รับสินค้าเนื่องจากไม่มีผู้รับ หรือไม่สามารถติดตามการจัดส่งสินค้าจากผู้จัดส่งได้ เราไม่มีส่วนรับผิดชอบค่าใช้จ่ายที่เกิดขึ้นเนื่องจากมีการเปลี่ยนแปลงข้อมูลของท่านเอง เช่น การเปลี่ยนแปลงที่อยู่สำหรับจัดส่ง

2. ค่าธรรมเนียมในการจัดส่ง

คำสั่งซื้อสินค้าทั้งหมดจัดส่งโดยผู้ให้บริการขนส่ง โดยค่าธรรมเนียมในการจัดส่งทั้งหมดจะปรากฏบนเว็บไซต์และปรากฏในการยืนยันคำสั่งซื้อ เมื่อเราได้ยืนยันคำสั่งซื้อของท่านแล้ว ทั้งนี้ เราไม่มีการจัดเก็บค่าธรรมเนียมการจัดส่งสินค้าภายในประเทศไทย

3. ขอบเขตการจัดส่งสินค้า

เราจัดส่งสินค้าของเราไปยังสถานที่ภายในราชอาณาจักรไทยเท่านั้น การจัดส่งออกไปยังนอกราชอาณาจักรไทยยังไม่สามารถกระทำได้

เราไม่สามารถจัดส่งสินค้าไปยังผู้รับที่มีที่อยู่ปลายทางเป็นตู้ไปรษณีย์ หรือสถานที่ที่มีข้อจำกัดในการให้บริการขนส่งตามที่ผู้ให้บริการขนส่งระบุได้

4. เอกสารใบกำกับภาษี

เอกสารใบกำกับภาษีจะถูกแนบไปกับสินค้าที่นำส่งถึงท่าน โปรดเก็บต้นฉบับใบกำกับภาษีเอาไว้เพื่อใช้ในการขอคืนหรือขอเปลี่ยนสินค้า หากท่านไม่ต้องการต้นฉบับใบกำกับภาษีกรุณาแจ้งความประสงค์ในหน้า “รายละเอียดการสั่งซื้อ” ทั้งนี้ หากท่านไม่ได้รับต้นฉบับใบกำกับภาษี โปรดติดต่อมายังฝ่ายบริการลูกค้า (อีเมล์ cs@solvil-et-titus.co.th หรือหมายเลขโทรศัพท์ (66) 02 984 0888 ภายใน 7 วัน (นับแต่วันที่ได้รับและมีการลงนามรับสินค้า)) และท่านจำเป็นต้องให้ข้อมูลการยืนยันคำสั่งซื้อสินค้าของท่าน ภายหลังจากที่เราได้รับข้อมูลการยืนยันคำสั่งซื้อสินค้าของท่านแล้ว เราจะจัดส่งใบกำกับภาษีให้แก่ท่านอีกครั้งทางไปรษณีย์ภายใน 7 วัน

6. ช่องทางการชำระเงินและความปลอดภัย

เว็บไซต์ https://www.solvil-et-titus.co.th ได้จัดให้มีมาตรการรักษาความปลอดภัยหลายรูปแบบเพื่อรักษาความปลอดภัยในข้อมูลส่วนบุคคลของท่าน เมื่อท่านทำการสั่งซื้อกับเรา เราได้จัดให้มีเซอร์ฟเวอร์ (server) ที่มีความปลอดภัย โดยซอฟต์แวร์เซอร์ฟเวอร์ ที่มีความปลอดภัย (secure server software) และระบบคัดกรองข้อมูลเพื่อความปลอดภัย (Secure Sockets Layer (SSL)) เป็นผู้แปลงข้อมูลที่ท่านให้กับเราเป็นรหัสก่อนจะนำส่งให้กับเรา

7. นโยบายการคืนสินค้า

1) เงื่อนไขการคืนสินค้า

ก. ภายใต้เงื่อนไขการคืนสินค้าของเรา ท่านอาจติดต่อฝ่ายบริการลูกค้าเพื่อขอคืนสินค้าผ่านทางไปรษณีย์หรือตัวแทนจำหน่ายสินค้าในประเทศไทย และทางเราจะไม่รับคืนสินค้าที่ได้มีการตรวจรับไว้เกินกว่า 14 วัน

การขอคืนสินค้าผ่านทางไปรษณีย์

- กรุณาติดต่อเราทางอีเมล์ cs@solvil-et-titus.co.th หรือเบอร์โทรศัพท์ (66) 02 984 0888 โดยให้แจ้งเลขใบกำกับภาษีของท่านผ่านทางอีเมล์ เพื่อรับรหัสยืนยันการขอคืนสินค้า (RA code) ก่อนทำการส่งคืนสินค้า

- เมื่อทำการส่งคืนสินค้าที่มีข้อพกพร่อง กรุณาระบุข้อบกพร่องดังกล่าวให้ชัดเจน

- ท่านจะได้รับอีเมล์แจ้งรหัสยืนยันการขอคืนสินค้าและที่อยู่ในการจัดส่งสินค้าคืน ภายใน 3 วันทำการ

- เมื่อได้รับรหัสยืนยันการขอคืนสินค้า ให้ท่านส่งสินค้าพร้อมต้นฉบับใบกำกับภาษี และสำเนาอีเมล์ตอบกลับจากเรา (ที่มีการแจ้งรหัสยืนยันการขอคืนสินค้า) (“เอกสารสำหรับขอคืนสินค้า”) ทางไปรษณีย์ให้กับเรา ภายใน 7 วันทำการ

- เราจะไม่ยอมรับการคืนสินค้าที่ไม่มีเอกสารสำหรับขอคืนสินค้าประกอบ (สำหรับของขวัญที่สั่งซื้อโดยไม่มีการออกใบกำกับภาษี กรุณาติดต่อฝ่ายบริการลูกค้าทาง cs@solvil-et-titus.co.th)

การขอคืนสินค้าผ่านตัวแทนจำหน่ายสินค้าในประเทศไทย

- เมื่อทำการส่งคืนสินค้าที่มีข้อบกพร่อง กรุณาระบุข้อบกพร่องดังกล่าวให้ชัดเจน

- ท่านสามารถดูรายชื่อตัวแทนจำหน่ายสินค้าได้ที่ “ที่ตั้งร้านค้า”

- ท่านจะได้รับอีเมล์แจ้งรหัสยืนยันการขอคืนสินค้าและที่อยู่ของตัวแทนจำหน่ายสินค้า ภายใน 3 วันทำการ

- เมื่อได้รับรหัสยืนยันการขอคืนสินค้า ท่านต้องส่งคืนสินค้าพร้อมเอกสารสำหรับขอคืนสินค้าให้กับตัวแทนจำหน่ายสินค้าของเรา ภายใน 7 วันทำการ

ข. เรายอมรับการขอคืนสินค้าที่ซื้อจาก https://www.solvil-et-titus.co.th. เท่านั้น เราไม่ยอมรับสินค้าที่ซื้อกับตัวแทนจำหน่ายสินค้าผ่านทางเว็บไซต์นี้

ค. สินค้าที่ส่งคืนจะต้องอยู่ในสภาพเดิม เช่น มีลักษณะเหมือน ณ ขณะสั่งซื้อ พร้อมบรรจุภัณฑ์เดิม อุปกรณ์เสริม บัตรรับประกันสินค้าที่ยังไม่ได้ใช้ คู่มือการใช้สินค้า ของแถม และของสมนาคุณ ถ้ามี เราไม่สามารถคืนเงินให้สินค้าที่ชำรุด ถูกปรับเปลี่ยนขนาด หรือมีการสลักข้อความลงไปได้ ในกรณีที่ไม่มีการส่งคืนของแถม และของสมนาคุณท เราจะทำการเรียกเก็บค่าใช้จ่ายเพิ่มเติม

ง. เราจะพิจารณาว่าสินค้าที่ส่งคืนอยู่ในสภาพเดิมหรือไม่ (เช่น มีลักษณะเหมือน ณ ขณะสั่งซื้อ พร้อมบรรจุภัณฑ์เดิม อุปกรณ์เสริม บัตรรับประกันสินค้าที่ยังไม่ได้ใช้ คู่มือการใช้สินค้า ของแถม และของสมนาคุณ ถ้ามี) หลังจากได้รับสินค้าของท่านแล้ว ภายใน 7 วันทำการเราจะส่งอีเมล์แจ้งให้ทราบว่าคำขอคืนเงินของท่านได้รับการอนุมัติหรือไม่ การตัดสินใจของเราให้ถือเป็นที่สุด

จ. เราจะพิจารณาว่าสินค้าที่ส่งคืนมีข้อบกพร่องหรือไม่ และการตัดสินใจของเราให้ถือเป็นที่สุด

ฉ. ตัวแทนจำหน่ายสินค้านอกประเทศไทย จะไม่รับคืนสินค้าสำหรับการสั่งซื้อจาก https://www.solvil-et-titus.co.th

ช. หากการขอคืนสินค้าของท่านได้รับอนุมัติ เราจะคืนเงินให้ในราคาสุทธิต่อหน่วยของสินค้าที่ส่งคืนแต่ละรายการ โดยจ่ายเงินเข้าบัญชีเดิมที่ใช้ทำการสั่งซื้อให้กับผู้ทำธุรกรรม ดังต่อไปนี้

- การชำระผ่านธุรกรรมการเงินทางอินเตอร์เน็ต (Internet banking): จ่ายเงินคืนเข้าบัญชีของท่านภายใน 7 วันทำการ หลังจากคำขอคืนเงินได้รับอนุมัติ

- การชำระผ่านบัตรเครดิต (บัตรเครดิตที่ใช้ได้เฉพาะภายในประเทศ): จ่ายเงินคืนเข้าบัญชีของท่านภายใน 2-4 สัปดาห์ หลังจากคำขอคืนเงินได้รับอนุมัติ

- การชำระผ่านบัตรเครดิต (บัตรเครดิตที่ใช้ได้ทั้งในประเทศและต่างประเทศ): จ่ายเงินคืนเข้าบัญชีของท่านภายใน 4-8 สัปดาห์ หลังจากคำขอคืนเงินได้รับอนุมัติ

ซ. ค่าธรรมเนียมต่างๆ รวมถึงแต่ไม่จำกัดเพียงค่าธรรมเนียมดังต่อไปนี้ ไม่สามารถขอคืนได้:

- ค่าใช้จ่ายที่เกิดขึ้นระหว่างการสั่งซื้อสินค้า

ค่าธรรมเนียมใดๆ ที่เรียกเก็บโดยทูซีทูพี และ/หรือ ผู้ออกบัตรเครดิต ค่าประกันภัย และค่าใช้จ่ายอื่นๆ ที่เกี่ยวข้องกับการสั่งซื้อสินค้า ไม่สามารถขอคืนได้

- ค่าใช้จ่ายอันเกิดจากการส่งสินค้าคืนให้เรา

ค่าจัดส่งสินค้า รวมถึงค่าธรรมเนียมใดๆ ที่เรียกเก็บโดยทูซีทูพีและ/หรือ ผู้ออกบัตรเครดิต ค่าประกันภัย และค่าใช้จ่ายอื่นๆ ที่เกี่ยวข้อง ไม่สามารถขอคืนได้เช่นกัน

ฌ. เราขอสงวนสิทธิในการระงับข้อพิพาทต่างๆ โดยการส่งสินค้าคืน การขอคืนเงิน หรือการยกเลิกคำสั่งซื้อ

2) ขั้นตอนการคืนสินค้าทางไปรษณีย์

ก. กรุณาอ่านเงื่อนไขการคืนสินค้าอย่างละเอียดก่อนส่งคืนสินค้า

ข. ห่อบรรจุภัณฑ์ให้แน่นหนาและส่งสินค้าคืนพร้อมเอกสารสำหรับขอคืนสินค้า

ค. เพื่อผลประโยชน์ของท่าน ให้ส่งสินค้าที่จะคืนผ่านผู้รับขนที่สามารถติดตามได้ หรือผู้ให้บริการส่งสินค้าที่สามารถชำระเงินล่วงหน้าได้ โดยท่านเป็นผู้รับผิดชอบค่าใช้จ่ายในการส่งสินค้าคืนทั้งหมด การส่งแบบ “เก็บค่าใช้จ่ายปลายทาง” จะถูกปฏิเสธ

ง. กรุณาทำประกันสินค้าของท่านด้วยวงเงินเท่ากับราคาสุทธิต่อหน่วย เราไม่รับผิดชอบในความเสียหายหรือความสูญเสียใดๆ ของสินค้าที่ส่งคืนที่ไม่มีการทำประกันภัย

จ. ส่งสินค้าไปยังที่อยู่ที่เราให้ไว้เมื่อแจ้งรหัสยืนยันการขอคืนสินค้า อย่าส่งสินค้าไปยังที่อยู่ใดๆ ที่ปรากฎในเอกสารอื่นของเรา หรือที่ปรากฎในเว็บไซต์ ไม่เช่นนั้นเราอาจไม่สามารถติดตามการส่งสินค้าคืนได้ และเราจะไม่รับผิดชอบในกรณีสินค้าสูญหายระหว่างการขนส่ง

ฉ. เมื่อเราได้รับสินค้าที่ส่งคืน จะดำเนินการประเมินและตรวจสอบ ก่อนอนุมัติหรือหรือไม่อนุมัติการส่งคืนดังกล่าว หลังจากได้รับสินค้าของคุณแล้ว ภายใน 7 วันทำการ เราจะส่งอีเมล์แจ้งให้ทราบว่าคำขอคืนเงินของท่านได้รับอนุมัติหรือไม่

3) ขั้นตอนการคืนสินค้าผ่านตัวแทนจำหน่ายสินค้าในประเทศไทย

ก. กรุณาอ่านเงื่อนไขการคืนสินค้าโดยละเอียด ก่อนส่งคืนสินค้า

ข. หลังจากได้รับรหัสยืนยันการขอคืนสินค้า กรุณาไปพบตัวแทนจำหน่ายสินค้าของเรา พร้อมด้วยสินค้าและเอกสารสำหรับขอคืนสินค้า ตัวแทนจำหน่ายสินค้าจะตรวจสอบสินค้า และบันทึกข้อมูลลงในแบบฟอร์มส่งคืนสินค้า เพื่อระบุสภาพของสินค้าและยืนยันว่าเราได้รับสินค้าคืนแล้ว ท่านต้องลงชื่อในแบบฟอร์มส่งคืนสินค้า เพื่อรับทราบถึงรายละเอียดที่ระบุไว้ในแบบฟอร์มส่งคืนสินค้า

ค. เมื่อเราได้รับสินค้าที่ส่งคืน เราจะดำเนินการประเมินและตรวจสอบ ก่อนอนุมัติหรือหรือไม่อนุมัติการส่งคืนดังกล่าว หลังจากได้รับสินค้าของท่านภายใน 7 วันทำการ โดยเราจะส่งอีเมล์แจ้งให้ทราบว่าคำขอคืนเงินของท่านได้รับอนุมัติหรือไม่

8. นโยบายการเปลี่ยนสินค้า

1) เงื่อนไขการเปลี่ยนสินค้า

ก. ภายใต้เงื่อนไขการเปลี่ยนสินค้าของเรา ท่านอาจติดต่อฝ่ายบริการลูกค้าเพื่อขอเปลี่ยนสินค้าได้ภายใน 14 วัน ผ่านทางไปรษณีย์หรือตัวแทนจำหน่ายสินค้าในประเทศไทย และทางเราจะไม่รับคำขอใดๆ หลังจากผ่านไปแล้ว 14 วัน

การขอเปลี่ยนสินค้าผ่านทางไปรษณีย์

- กรุณาติดต่อเราทางอีเมล์ cs@solvil-et-titus.co.th หรือเบอร์โทรศัพท์ (66) 02 984 0888 โดยให้แจ้งเลขใบกำกับภาษีของคุณผ่านทางอีเมล์ เพื่อรับรหัสยืนยันการขอคืนสินค้า (RA code) ก่อนทำการส่งคืนสินค้า

- เมื่อได้รับรหัสยืนยันการขอคืนสินค้า ให้ท่านส่งสินค้าพร้อมต้นฉบับใบกำกับภาษีและสำเนาอีเมล์ตอบกลับจากทางเรา (ที่มีการแจ้งรหัสยืนยันการขอคืนสินค้า) (“เอกสารสำหรับขอเปลี่ยนสินค้า”) ทางไปรษณีย์ให้กับเราภายใน 7 วันทำการ

- เราจะไม่ยอมรับการคืนสินค้าที่ไม่มีเอกสารสำหรับขอเปลี่ยนสินค้าประกอบ(สำหรับของขวัญที่สั่งซื้อโดยไม่มีการออกใบกำกับภาษีกรุณาติดต่อฝ่ายบริการลูกค้าผ่าน cs@solvil-et-titus.co.th)

- หากคำขอเปลี่ยนสินค้าของท่านได้รับอนุมัติ ท่านต้องทำคำสั่งซื้อสินค้าใหม่ในเว็บไซต์ของเรา

- ในขั้นตอนนี้ เราจะนำขั้นตอนการคืนสินค้ามาใช้บังคับ โดยเราจะคืนเงินให้ในจำนวนเท่ากับราคาสุทธิต่อหน่วยของสินค้าที่ส่งคืนแต่ละรายการ ท่านต้องทำคำสั่งซื้อสินค้าใหม่ในเว็บไซต์ของเรา (โปรดเน้นย้ำว่า ท่านจะสั่งซื้อสินค้าใหม่ได้ หลังจากมีการยืนยันจากเราว่าได้รับสินค้าที่คุณส่งคืนแล้วเท่านั้น) การจัดส่งสินค้าในประเทศไทยนั้นไม่มีค่าธรรมเนียม โปรดดูเพิ่มเติมในข้อ 2 กระบวนการสั่งซื้อ และข้อ 4 การประกันภัย สำหรับคำสั่งซื้อใหม่และนำ “เงื่อนไขการคืนสินค้า” ในส่วนของนโยบายการคืนสินค้ามาใช้กับค่าใช้จ่ายที่เกิดขึ้นเมื่อมีการคืนสินค้าด้วย

- เราจะพิจารณาว่าสินค้าที่ส่งคืนอยู่ในสภาพเดิมหรือไม่ (เช่น มีลักษณะเหมือน ณ ขณะสั่งซื้อ พร้อมบรรจุภัณฑ์เดิม อุปกรณ์เสริม บัตรรับประกันสินค้าที่ยังไม่ได้ใช้ คู่มือการใช้สินค้า และของสมนาคุณ) การตัดสินใจของเราให้ถือเป็นที่สุด

การขอเปลี่ยนสินค้าผ่านตัวแทนจำหน่ายสินค้าในประเทศไทย

- กรุณาติดต่อเราทางอีเมล์ cs@solvil-et-titus.co.th หรือเบอร์โทรศัพท์ (66) 02 984 0888 โดยให้แจ้งเลขใบกำกับภาษีของท่าน ชื่อตัวแทนที่ต้องการส่งสินค้าคืน และสินค้าที่เลือกจะเปลี่ยน (หากต้องการ) ผ่านทางอีเมล เพื่อขอรับรหัสยืนยันการขอคืนสินค้า (RA code) ก่อนทำการส่งคืนสินค้า ท่านสามารถดูรายชื่อตัวแทนจำหน่ายสินค้าได้ที่เมนูที่ตั้งร้านค้าในเว็บไซต์นี้ ทางเราจะตรวจสอบความพร้อมของสินค้าที่ท่านต้องการเปลี่ยน

(1) หากสินค้าที่ท่านเลือกจะเปลี่ยนพร้อมให้บริการ เราจะส่งรหัสยืนยันการขอคืนสินค้าและที่อยู่ของตัวแทนจำหน่ายสินค้าให้ท่านทางอีเมล์ภายใน 3 วันทำการ หลังจากได้รับอีเมล์ของท่าน

(2) หากสินค้าที่ท่านเลือกจะเปลี่ยนไม่มีในคลังสินค้า เราจะเสนอสินค้าอื่นให้ท่านเปลี่ยนผ่านทางอีเมล์ ภายใน 3 วันทำการหลังจากได้รับอีเมล์ของท่าน กรุณาเลือกสินค้าอื่นที่จะเปลี่ยนโดยการตอบกลับอีเมล์หาเราภายใน 3 วันทำการ นับจากได้รับข้อเสนอ เมื่อได้รับการยืนยันถึงสินค้าใหม่ที่เลือกจะเปลี่ยนจากท่าน เราจะส่งรหัสยืนยันการขอคืนสินค้าและที่อยู่ของตัวแทนจำหน่ายสินค้าให้กับท่านภายใน 3 วันทำการ หากท่านไม่ประสงค์จะเลือกสินค้าที่เสนอให้ กรุณาแจ้งให้ทราบภายใน 3 วันทำการหลังจากได้รับข้อเสนอ เพื่อเราจะได้ดำเนินการคืนเงินให้ท่าน

- เมื่อได้รับรหัสยืนยันการขอคืนสินค้า ให้ท่านส่งสินค้าพร้อมต้นฉบับใบกำกับภาษี และเอกสารสำหรับขอเปลี่ยนสินค้าให้ตัวแทนจำหน่ายสินค้าของเราภายใน 7 วันทำการ นับตั้งแต่ได้รับรหัสยืนยันการขอคืนสินค้า

- ตัวแทนจำหน่ายสินค้าของเราจะพิจารณาว่า สินค้าที่ส่งคืนอยู่ในสภาพเดิมหรือไม่ (เช่น มีลักษณะเหมือนในขณะสั่งซื้อ พร้อมบรรจุภัณฑ์เดิม อุปกรณ์เสริม บัตรรับประกันสินค้าที่ยังไม่ได้ใช้ คู่มือการใช้สินค้า และของสมนาคุณ) และการตัดสินใจของเราให้ถือเป็นที่สุด

- หากท่านและตัวแทนจำหน่ายสินค้าของเราไม่สามารถบรรลุข้อตกลงเรื่องสภาพของสินค้าได้ ตัวแทนของเราจะบันทึกข้อมูลลงในแบบฟอร์มส่งคืนสินค้าและยืนยันว่าเราได้รับสินค้าคืนแล้ว ท่านต้องลงชื่อในแบบฟอร์มส่งคืนสินค้า เพื่อรับทราบถึงรายละเอียดที่ระบุไว้ในแบบฟอร์มส่งคืนสินค้า สินค้าจะถูกส่งมาที่เราเพื่อตรวจสอบ ซึ่งจะใช้เวลา 3-5 วันทำการ การตัดสินใจของเราให้ถือเป็นที่สุด

- หากราคาสุทธิต่อหน่วยของสินค้าที่เปลี่ยนให้ต่ำกว่าราคาสุทธิต่อหน่วยของสินค้าที่ส่งคืน เราจะไม่คืนส่วนต่างดังกล่าวให้ หากราคาสุทธิต่อหน่วยของสินค้าที่เปลี่ยนให้สูงกว่าราคาสุทธิต่อหน่วยของสินค้าที่ส่งคืน ท่านต้องชำระส่วนต่างดังกล่าว

ข. สำหรับการเปลี่ยนสินค้าผ่านทางไปรษณีย์และตัวแทนจำหน่ายสินค้า สินค้าจะต้องถูกส่งคืนในสภาพและในบรรจุภัณฑ์เดิม (รวมถึงป้ายสินค้า บัตรรับประกันสินค้าที่ยังไม่ได้ใช้ ชิ้นส่วนสำรอง ของแถม และของสมนาคุณ ถ้ามี) โดยปราศจากร่องรอยความเสียหาย การดัดแปลง หรือการเสื่อมสภาพ ในกรณีที่ไม่มีการส่งคืนของแถม และ/หรือ ของสมนาคุณ เราจะทำการเรียกเก็บค่าใช้จ่ายเพิ่มเติม เราไม่สามารถเปลี่ยนนาฬิกาข้อมือที่ใช้งานแล้ว ถูกปรับเปลี่ยนขนาด หรือมีการสลักข้อความลงไปให้ท่านได้

ค. การเปลี่ยนสินค้าผ่านทางไปรษณีย์และตัวแทนจำหน่ายสินค้า สามารถเปลี่ยนได้แค่หนึ่งครั้งเท่านั้น

2) ขั้นตอนการเปลี่ยนสินค้าทางไปรษณีย์

ก. กรุณาอ่านเงื่อนไขการเปลี่ยนสินค้าโดยละเอียด ก่อนเปลี่ยนสินค้า

ข. เมื่อได้รับรหัสยืนยันการขอคืนสินค้าและที่อยู่ในการจัดส่งสินค้าคืนทางอีเมล์ ห่อบรรจุภัณฑ์ให้แน่นหนาและส่งสินค้าคืนพร้อมเอกสารสำหรับขอเปลี่ยนสินค้า

ค. เพื่อผลประโยชน์ของท่าน ให้ส่งสินค้าที่จะคืนผ่านผู้รับขนที่สามารถติดตามได้หรือผู้ให้บริการส่งสินค้าที่สามารถชำระเงินล่วงหน้าได้โดยท่านเป็นผู้รับผิดชอบค่าใช้จ่ายในการส่งสินค้าคืนทั้งหมด การจัดส่งแบบ“เก็บค่าใช้จ่ายปลายทาง” จะถูกปฏิเสธ

จ. ส่งสินค้าไปยังที่อยู่ที่เราให้ไว้เมื่อแจ้งรหัสยืนยันการขอคืนสินค้า อย่าส่งสินค้าไปยังที่อยู๋ใดๆ ที่ปรากฎในเอกสารอื่นของเรา หรือที่ปรากฎในเว็บไซต์ ไม่เช่นนั้นเราอาจไม่สามารถติดตามการส่งสินค้าคืนได้ และเราจะไม่รับผิดชอบในกรณีสินค้าสูญหายระหว่างการขนส่ง

ฉ. เมื่อเราได้รับสินค้าที่ส่งคืน จะดำเนินการประเมินและตรวจสอบ ก่อนอนุมัติหรือหรือไม่อนุมัติการส่งคืนดังกล่าว หลังจากได้รับสินค้าของท่านแล้ว ภายใน 7 วันทำการ เราจะส่งอีเมล์แจ้งให้ทราบว่าคำขอเปลี่ยนสินค้าของท่านได้รับอนุมัติหรือไม่

ช. คุณต้องรับผิดชอบค่าภาษีอากรทั้งหมด และค่าขนส่งสำหรับสินค้าที่มีคำสั่งซื้อใหม่

3) ขั้นตอนการเปลี่ยนสินค้าผ่านตัวแทนจำหน่ายสินค้าในประเทศไทย

ก. กรุณาอ่านเงื่อนไขการเปลี่ยนสินค้าอย่างละเอียด ก่อนเปลี่ยนสินค้า

ข. หลังจากได้รับรหัสยืนยันการขอคืนสินค้าที่อยู่ของตัวแทนจำหน่ายสินค้า และความพร้อมในการให้บริการของสินค้าที่เลือกให้ส่งสินค้า (โดยอยู่ในสภาพเดิม โปรดดูเพิ่มเติมที่ เงื่อนไขการคืนสินค้า) พร้อมเอกสารสำหรับขอเปลี่ยนสินค้า(สำหรับของขวัญที่สั่งซื้อโดยไม่มีการออกใบกำกับภาษีกรุณาติดต่อฝ่ายบริการลูกค้าผ่านทาง cs@solvil-et-titus.co.th)

ค. ตัวแทนจำหน่ายสินค้าของเราจะทำการตรวจสอบสินค้า เมื่อตรวจสอบแล้วพบว่าสินค้าอยู่ในสภาพเดิม และปราศจากร่องรอยความเสียหาย การดัดแปลง หรือการเสื่อมสภาพ เราจะจัดเตรียมเปลี่ยนสินค้าตามที่ท่านได้เลือก หากปรากฏว่าสินค้าไม่เป็นไปตามที่เงื่อนไขที่กำหนดข้างต้น การขอเปลี่ยนสินค้าของท่านจะถูกปฎิเสธ

9. การรับประกันสินค้า

สินค้าที่เราจำหน่ายเป็นของแท้ โดยมีระยะเวลารับประกันทั่วโลก 2 ปี นับจากวันที่ซื้อ

การรับประกันดังกล่าวไม่ครอบคลุมถึง กำไล คริสตัล แบตเตอรี่ กรอบหน้าปัด หรือความเสียหายจากความชื้น (หากสินค้ากันน้ำไม่ได้) หรือไม่สามารถเรียกร้องได้ในกรณีที่มีหลักฐานแสดงว่ามีการใช้ผิดวิธี หรือใช้ในทางที่ผิด รวมถึงความเสียหายที่ไม่ได้เกิดจากการให้บริการของตัวแทนจำหน่ายสินค้า สินค้าที่เสียหายเนื่องจากการเสื่อมสภาพไม่ถือว่าเป็นการเสียหายจากขั้นการผลิต

ระหว่างช่วงการรับประกันสินค้า ท่านอาจส่งสินค้าคืนผ่านไปรษณีย์ชำระค่าบริการล่วงหน้า หรือผ่านตัวแทนจำหน่ายสินค้าของเรา ท่านสามารถดูรายชื่อตัวแทนจำหน่ายสินค้าได้ที่ "ที่ตั้งร้านค้า" หากไม่สามารถหาศูนย์บริการที่อยู่ใกล้เคียงได้ ท่านอาจส่งคืนสินค้าเพื่อรับบริการหลังการขาย โดยติดต่อฝ่ายบริการลูกค้าทางอีเมล์ cs@solvil-et-titus.co.th หรือเบอร์โทรศัพท์ (66) 02 984 0888 (โดยต้องส่งสินค้าคืนผ่านทางไปรษณีย์ชำระค่าบริการล่วงหน้า) โปรดส่งสินค้ามาพร้อมกับบัตรรับประกันที่ยังไม่หมดอายุ

ในกรณีความเสียหายเกิดจากขั้นตอนการผลิต ซึ่งครอบคลุมอยู่ในการประกันสินค้า เราอาจทำการคืนเงิน เปลี่ยนสินค้า หรือซ่อมแซมส่วนที่เสียหาย ในส่วนของการเปลี่ยนสินค้า จะขึ้นอยู่กับความพร้อมของสินค้าในคลังสินค้า

1) การห่อของขวัญ

หากคุณต้องการให้เราห่อของขวัญ กรุณาระบุมาใน "หมายเหตุการสั่งซื้อ" ในหน้า “รายละเอียดการสั่งซื้อ” เพื่อตอบสนองความประสงค์ในการให้ของขวัญของท่าน เราจะจัดส่งสินค้าที่ท่านซื้อในกล่องของขวัญหรือในถุง รวมถึงเขียนข้อความของคุณลงบนการ์ดของขวัญโดยไม่คิดค่าใช้จ่าย

I. TERMS AND CONDITIONS

We provide you with the Services strictly subject to these Terms of Use so please read them carefully. By accessing and browsing this Website, you accept and consent to these Terms of Use. We may amend these Terms of Use and other rules and policies relevant to the use of this Website without prior notice. Your continuing use of the Services will be deemed as your acceptance of the revised Terms of Use.

1. Terminology

The following commonly used terminology at this Website mean:

a. “Affiliates” mean in relation to us, another company that is a direct or indirect subsidiary of, or a direct or indirect holding company of, or another direct or indirect subsidiary of such a direct or indirect holding company of, us;

b. “Business Partners” mean:

e. “Net Price per Unit” refers to the Selling Price of each unit of Product after apportioning (where applicable) and deducting discounts, promotions or other price reductions offered by us;

f. “Order” means an order for Products placed by you and allocated an order number by us;

g. “Personal Data” means any information relating to an identified or identifiable individual (e.g. name, contact number, email address, physical address, gender, date of birth, etc.);

h. “Products” mean the products made available to you at this Website;

i. “Selling Price” refers to the price of each Product as listed on this Website;

j. “Registration Details” mean the information you supply to us when you use the Services;

k. “Services” mean the services made available to you at this Website, and incidental services, like after-sales, payment processing and shipping;

l. “Stores” mean physical retail store or stores operated by our Affiliates and who are our authorised retailers;

m. “we”, “us” or “our” means City Chain (Thailand) Co., Ltd. and its successors and assigns;

2. Pricing and Discounts

All prices listed here apply to purchases at this Website only. All other discounts or promotions which are not available through this Website are not valid for purchases.

We may vary the prices at this Website at any time without prior notice.

3. Personal Use

All Products sold are for personal use only. Material and information posted on our Website are for personal use only. No re-sale or other commercial use is allowed.

4. When we accept your order

We reserve the right not to accept Orders for Products or Services. By registering and completing the Purchase Procedure, you offer to purchase our Products. We will send you an Order Acknowledgement by e-mail to acknowledge your Order. However, this is not an acceptance of your Order. We will only send you an Order Delivery Notification of your Order once we have checked availability of stock and carrier service.

5. TITLE AND RISK OF LOSS

Risk of loss and title for Products purchased pass to you upon delivery to the carrier.

6. INTELLECTUAL PROPERTY RIGHTS

You acknowledge and agree that all Intellectual Property Rights that vest in the original works comprised within the Services or ancillary to it are owned by us, or are licensed to us by third parties. We reserve all Intellectual Property Rights in the Services, including but not limited to the contents of this Website and the domain name https://www.solvil-et-titus.co.th. Your use of the Services does not entitle you to claim ownership of any Intellectual Property Rights in the Services or this Website.

7. COOKIES

a. We may obtain information about your computer, including, where applicable, your IP address, operating system and browser type, for administration of the system and statistical analysis. This is used to obtain statistical data on how you browse our Website.

b. We may obtain information about your online movements and general Internet use by means of a cookies file that is stored in your computer's hard drive for the same reason. The cookies contain information that is transferred to your computer's hard drive.

All prices displayed on this Website are quoted in Thai Baht.

Our Business Partners working with us to provide and promote the Services include, 2C2P (Thailand) Co., Ltd. (“2C2P”), Kerry Express (Thailand) Limited (“Kerry Express”) and insurance and courier companies. Please carefully read the terms and conditions with respect to the payment and shipping services provided by 2C2P and Kerry Express respectively and their privacy policies before proceeding with your Order. By proceeding with your Order, you will be deemed to have accepted the terms and conditions and privacy policies of our Business Partners.

10. MINORS

Persons under 20 years old should use our Website only under the guidance of a parent or guardian.

11. NO AGENCY

Our Business Partners are contractors who act independently and as such do not act as our agents, employees, representatives or their equivalent.

12. COMMUNICATION FROM YOU

Any communication or material you transmit to this Website by e-mail or otherwise, including any data, questions, comments, suggestions or the like is, and will be treated as non-confidential and non-proprietary. Anything you transmit or post becomes the property of City Chain (Thailand) Co., Ltd. and may be used for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. We assume the right to use any ideas, concepts, know-how or techniques contained in any communication you send to this Website for any purpose including, but not limited to, developing, manufacturing and marketing Products using aforesaid information. Personal data collected will remain confidential and will be treated in accordance with our Privacy Policy Statement.

13. EXCLUSION OF REPRESENTATIONS AND WARRANTIES

We will use reasonable commercial efforts to include accurate and up to date information on this Website, but we make no representations or warranties as to its accuracy. Neither City Chain (Thailand) Co., Ltd., its Affiliates nor any other party involved in creating, producing or delivering this Website shall be liable for any direct, indirect, special, incidental, or consequential, damages losses, costs and expenses arising out of or in any way in connection with your access to or use of this Website. Everything on this Website is provided to you "as is" without any express or implied warranties, including, warranties of merchantability or fitness for a particular purpose.

We do not warrant that the functioning of this Website will be error free, that defects will be corrected, that this Website or host server is malware free or will not be interrupted due to technical problems or is hack-free.

We are not responsible for the content of any websites linked to our Website or for any services offered by linked sites and take no responsibility for, and give no warranties, guarantees or representations in respect of such links.

We are not responsible for the actions of our Business Partners (including a person or body corporate with whom our Business Partners enter into arrangements with to provide services to you (“Business Partner Affiliates”)) and make no representations or warranties with respect to the services they provide to you in connection with your use of this Website, the Services or the purchase of the Products.

14. LIMITATION OF LIABILITY

a. To the fullest extent permissible under applicable law and save for and limited to the Return Policy under Section VII, Exchange Policy under Section VIII and international warranty described under Section IX, we disclaim any and all representations or warranties of any kind, whether express or implied, in relation to the Products and our Services.

b. We will not be liable to you, or any third party in contract, tort or otherwise for any claims, liabilities, losses, damages, costs and expenses under, arising from or in connection with your use of and the functioning of this Website (including but not limited to any interruption, introduction of malware, hacking, inaccuracy, error or omission) or the provision of the Products or Services regardless of cause and as such we accept no liability for any claims, liabilities, losses, damages, costs and expenses arising therefrom.

c. We will not be liable to you or any third party in contract, tort or otherwise for any claims, liabilities, losses, damages, costs and expenses under, arising from or in connection with the services provided to you by our Business Partners and/or Business Partner Affiliates in relation to your use of this Website, the Services or Products regardless of cause and as such we accept no liability for any claims, liabilities, losses, damages, costs and expenses arising therefrom.

d. Notwithstanding any other provisions to the contrary in these Terms of Use, our maximum cumulative liability to you or to any other party in contract, tort, or otherwise for any claims, liabilities, losses, damages, costs and expenses under, arising from or in connection with your use of this Website and Services and the sale of Products to you shall not in any circumstances exceed the cumulative sum paid by you to us under an Order. BUT in no event shall we be liable to you for any loss of profits, business contracts, sales, or for any special, indirect, incidental or consequential damages or losses of any nature.

15. INDEMNITY

You agree to fully indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all and any claims, liabilities, losses, damages, costs and expenses, of any type and nature including but not limited to indirect, special, incidental, and/or consequential losses and damages and legal fees, arising from or in connection with any breach of these Terms of Use by you or any other liabilities arising from or in connection with your use of this Website and the Services, or the use by any other person accessing this Website using your shopping account and/or your personal information.

16. CUSTOMER’S REPRESENTATIONS AND OBLIGATIONS

You warrant and represent to us that (i) you have the authority and legal capacity to agree to these Terms of Use; (ii) the personal information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; (iii) you will notify us immediately of any changes to your personal information by contacting customer services at cs@solvil-et-titus.co.th; (iv) you will comply with all applicable agreements, law, statutes, ordinances and regulations with regard to the use of the Services; (v) you will not introduce any malware to this Website and (vi) you will not introduce any material that is unlawful, defamatory, indecent, obscene or abusive in any way. You agree not to impersonate any other person or entity or to use a false name or a name you are not authorised to use. You agree to notify us of any actual or suspected misuse of your User ID and Password. You agree that we may deny access to the Services if we know or reasonably suspect that your User ID and / or Password is being misused.

17. CIRCUMSTANCES BEYOND OUR CONTROL (FORCE MAJEURE)

a. We shall not be liable to you for any breach, hindrance or delay in the performance of our provision of Service attributable to any cause beyond our reasonable control, including without limitation:

(1) Strikes, lock-outs or other industrial action.

(2) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

(3) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.

(4) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

(5) Impossibility of the use of public or private telecommunications networks.

(6) The acts, decrees, legislation, regulations or restrictions of any government, shipping, postal or other relevant transport strike, failure or accidents.

(7) Failures of the internet or any public telecommunications network, failures of our hosting provider, hacker attacks, denial of service attacks, virus or other malicious software attacks or infections or power failures or failures of your computer systems or networks.

b. In the circumstance that the Force Majeure event lasts for more than one week, either you or we may cancel the Order forthwith by written notice and without any Liability other than a refund of a Product already paid for by you and not delivered.

c. If we have contracted to provide identical or similar Products to more than one Customer and are prevented from fully meeting our obligations to you by reason of a Force Majeure event, we may decide at our absolute discretion which Order we will process and to what extent.

d. We reserve absolute discretion on the solution we adopt in fully meeting our obligations under each Order despite the Force Majeure event.

18. TERMINATION

We may terminate your registration or access to this Website immediately if you are in breach of these Terms of Use. Any accrued rights at the date of termination will remain enforceable after termination.

19. GOVERNING LAW

The laws of Thailand without regard to principles of conflict of laws, will govern your use of this Website and any disputes that may arise between you and us at this Website.

20. JURISDICTION

Any dispute arising from and connected with your visit to this Website, the Services or the Products you purchase shall be submitted to the non-exclusive jurisdiction of the courts of Thailand.

21. LANGUAGE

In the event of inconsistencies between the English and Thai versions of these Terms of Use, the English version shall prevail.

II. PURCHASE PROCEDURE

1. Select the Products and View the Product Information

Select the Products you want to purchase by clicking on the “add to cart” button. After adding the Products to the “Shopping Cart”, you can click the “View Cart” button and you will be directed to the “Shopping Cart” where you may view the Product details and choice of colours. In addition, you may find recommendations of related Products corresponding to your selected Products.

2. Put the Products in the Shopping Cart

Your Shopping Cart shows the Products you intend to buy, the quantity, shipping charges and the total amount to be paid etc. You can adjust the Products or quantity you are going to purchase.

3. Registration

You may register as a member to enjoy members-only benefits, such as occasional discounts and checking your Order history at this Website. If you would like to register as a member, please fill in the registration form. It is not compulsory to be a registered member to make a purchase.

4. Checkout Details

The checkout details will show your selected Products, quantity, shipping charges, total amount to be paid and the engraved message (if applicable).

5. Fill in the Billing Information and Delivery Information and Proceed to Payment

After confirming your Order details, please fill in the shipping and billing information. When you have filled in all the details, you can proceed to payment by clicking “Check out with 2C2P”. You will be re-directed to 2C2P’s website to complete the payment procedures.

6. Order Receipt

After you have completed the payment procedures, you will be re-directed to the page of our Website confirming the receipt of your Order. You can view your Order details, Order number, total payment amount and payment method. You will also receive an Order confirmation by e-mail from us. For details of delivery, please see also Delivery Service.

Once you have settled the payment, the Order cannot be cancelled.

7. Order Confirmation

When the processing of your Order is confirmed, you will receive an e-mail stating the Order details and access details to a shipment tracking platform (Kerry Express) once the Product is in shipment. You may track the progress of your shipment by accessing the shipment tracking platform.

8. Cancellation of Order

Your Order cannot be cancelled once your payment is processed. You may only request for a return or exchange of the Product under Part VII Return Policy or Part VIII Exchange Policy of these Terms of Use.

III. NON EXPORTATION POLICY

We have no policy to sell our Products available on this Website to a customer outside Thailand. For deliveries outside Thailand, please visit other websites of Solvil et Titus SA at https://www.solvil-et-titus.hk/ and https://www.solvil-et-titus.sg/.

IV. INSURANCE

Insurance covers the Net Price per Unit of each Product and provides you a refund if the Product is lost or damaged during shipment. The insurance does not cover delays in delivery or shipment.

V. DELIVERY SERVICE

1. Delivery Time

Our Business Partner for shipping services is Kerry Express and you may read Kerry Express’s terms and conditions at https://th.kerryexpress.com/en/our-services/terms.php.
All Orders received will be processed within 2 working days of receipt. Upon Order confirmation, customers can expect to receive their Orders within 3-4 working days, subject to different destinations. Please note that the above delivery times are not a guarantee of actual delivery times.

We are not responsible for any damage, destruction or loss of the Products or late delivery, wrong or missed pick up or tracking issues with the courier. We are not liable for costs sustained as a result of a change in information on your side, for example, change of shipping address.

2. Shipping Cost

All Orders are delivered by courier service. Total shipping costs will be shown on the Website and the Order confirmation when we confirm your Order. Deliveries within Thailand are free.

3. Delivery Territories

We will only deliver our Products to specified location within the Kingdom of Thailand. Delivery to territories outside the Kingdom of Thailand is currently unavailable.

Shipments cannot be made to P.O. boxes, or locations where delivery services are limited by the carrier.

4. Printed Tax Invoice

A printed tax invoice will be enclosed in the Product shipped to you. Please keep the original tax invoice for return and exchange of Product. If you do not require the original tax invoice, please indicate this in the “Checkout” page. If you do not receive the printed tax invoice, please contact our customer service (email: cs@solvil-et-titus.co.th or phone: (66) 02 984 0888 within 7 days (from the date when delivery was signed and received) and you will be required to provide the Order confirmation of your purchase of Product. Upon receiving the email confirmation of your purchase of Product, we will send you the re-issued tax invoice by mail within 7 days.

https://www.solvil-et-titus.co.th implements a variety of security measures to maintain the safety of your personal information. When you place Orders with us, we offer the use of a secure server. The secure server software, Secure Sockets Layer (SSL) encrypt all information you provide before it is sent to us.

VII. RETURN POLICY

1. Terms of Return

a. Under our return policy you may contact our customer services for return of Product by mail or at our authorised retailers in Thailand. We will not entertain any return of Product after 14 days.

Return by Mail

- Please contact us through cs@solvil-et-titus.co.th or phone (66) 02 984 0888 indicating your tax invoice number by e-mail to get a Return Authorisation (RA) code before return.

- When returning a defective Product, please clearly state the defect for return.

- The RA code and the address for return will be emailed to you within 3 working days.

- The Product together with the original tax invoice and a copy of our email reply (indicating your RA code for return) (“Required Documents for Product Return”) must be posted to us by mail within 7 working days upon receiving the RA code.

- We will not accept returns without Required Documents for Product Return (For gift purchase without a tax invoice, please contact customer services through cs@solvil-et-titus.co.th).

Return at Authorised Retailers

- Please contact us through cs@solvil-et-titus.co.th or phone (66) 02 984 0888 indicating your tax invoice number and preferred authorised retailer for return to get a Return Authorisation (RA) code before return.

- When returning a defective Product, please clearly state the defect for return.

- You may view the list of authorised retailers at the Store Locator.

- The RA code and authorised retailer’s address will be emailed to you within 3 working days.

- The Product together with the Required Documents for Product Return must be returned to our authorised retailer within 7 working days upon receiving the RA code.

- We will not accept returns without Required Documents for Product Return (For gift purchase without a tax invoice, please contact customer services through cs@solvil-et-titus.co.th).

b. We only accept the return of Products purchased from https://www.solvil-et-titus.co.th. Returns for Products purchased at our authorised retailers will not be accepted through this Website.

c. The Product must be returned in its original condition, i.e. in the same condition as when originally purchased with all original packaging materials, accessories, unused warranty cards, instruction booklets, free gift and gift redemptions, if any. We are unable to refund worn, sized or engraved Products. If a free gift and/or gift redemption item is not returned, additional charges will be applied.

d. We will determine whether a returned Product is in its original condition (i.e. in the same condition as when originally purchased with all original packaging materials, accessories, unused warranty cards, instruction booklets and gift redemption). Upon receiving your Product, we shall send you an email within 7 working days informing you whether your request for refund is accepted. Our decision will be final.

e. We will determine whether a returned Product is defective, and our decision will be final.

f. Authorised retailers outside of Thailand DO NOT ACCEPT returns for https://www.solvil-et-titus.co.th

g. If your return of Product is accepted, we will refund the Net Price per Unit of each returned Product. The refund will be credited to the original payment account, to the same person who paid for the transaction as follows:

- Internet banking payment: The refund will be credited to your account within 7 working days after your request for refund is accepted.

- Credit Card payment (local card): The refund will be credited to your account within 2-4 weeks after your request for refund is accepted.

- Credit Card payment (International card): The refund will be credited to your account within 4-8 weeks after your request for refund is accepted.

h. Fees including but not limited to the following items will not be refunded:

- Costs incurred during the purchase of Product

Any fees charged by 2C2P and/or credit card issuers, insurance costs and all other related miscellaneous costs incurred for the purchase of the Product will not be refunded.

Costs incurred for the return of Products to us

Shipping costs, any fees charged by 2C2P and/or credit card issuers, insurance costs and all other related miscellaneous costs will also not be refunded.

i. We reserve the right to handle any disputes by return of Products, refunds or cancellation of Order.

2. Procedure for Return by Mail

a. Please read Terms of Return carefully before your return.

b. Wrap the package securely and return the Products together with the Required Documents for Return.

c. For your protection, ship your return via a traceable carrier, or a prepaid courier service. All the return shipping charges are to be borne by you. “Collect Charge” shipment will be refused.

d. Please insure your Product for its Net Price per Unit. We are not responsible for the damage or loss for returned Products that are not insured.

e. Send your return package to the address we provide when we give you the RA code. Please DO NOT return the Products to any address in our other documents, or in our Website or we may not be able to trace the return shipment and we will not be responsible for the lost shipment in transit.

f. Once your returned package has been received by us, it is processed and inspected before we proceed in approving or disapproving the return. Upon receiving your Product, we shall send you an email within 7 working days informing you whether your request for refund is accepted.

3. Procedure for Return to Our Authorised Retailers in Thailand

a. Please read Terms of Return carefully before your return.

b. After obtaining the RA code, please visit our authorised retailer with the Product and Required Documents for Return. The authorised retailer will conduct an inspection of the Product and fill in the Return Instruction Form to specify the condition of the Product and confirm our receipt of the Product. You are required to sign the Return Instruction Form to acknowledge the details stated in the Return Instruction Form.

c. Once your returned package has been received by us, it is processed and inspected before we proceed in approving or disapproving the return. Upon receiving your Product, we shall send you an email within 7 working days informing you whether your request for refund is accepted.

VIII. EXCHANGE POLICY

1. Terms of Exchange

a. Under our exchange policy, you may contact our customer services for exchange of Product within 14 days by mail or at our authorised retailers in Thailand. We will not entertain requests made after 14 days.

Exchange by Mail

- Please contact us through cs@solvil-et-titus.co.th or phone (66) 02 984 0888 indicating your tax invoice number by e-mail to get a Return Authorisation (RA) code before return.

- The RA code and the address for return will be emailed to you within 3 working days.

- The Product together with the original tax invoice and a copy of our email reply (indicating your RA code for exchange) (“Required Documents for Exchange”) must be posted to us by mail within 7 working days upon receiving the RA code.

- We will not accept returns without Required Documents for Exchange (For gift purchase without a tax invoice, please contact customer services through cs@solvil-et-titus.co.th).

- If your request for exchange is accepted, you are required to make a new Order at our Website.

- The procedures of Return will be applied. We will refund the Net Price per Unit of each Product. You are required to make a new Order at our Website (please be reminded that you shall only make a new Order after receiving our confirmation of acceptance of your return). Deliveries within Thailand are free. Please refer to II. Purchase Procedures and IV. Insurance for the new Order Procedures. For other costs incurred in the Return, “Terms of Return” section under Return Policy applies.

- We will determine whether a returned Product is in its original condition (i.e. in the same condition as when originally purchased with all original packaging materials, accessories, unused warranty cards, instruction booklets and gift redemption) and our decision will be final.

Exchange at Authorised Retailers

- Please contact us through cs@solvil-et-titus.co.th or phone (66) 02 984 0888 indicating your tax invoice number, preferred authorised retailer for return, chosen Product to exchange (optional) by e-mail to get a Return Authorisation (RA) code before return. You may view the list of authorised retailers at the Store Locator on this Website. We shall check the availability of your chosen Product.

i. If your chosen Product is available, we shall send you the RA code and authorised retailer’s address by email within 3 working days upon receiving your email.

ii. If your chosen Product is out of stock, we shall suggest other Products for exchange by email within 3 working days upon receiving your email. Please choose another Product for exchange by replying us within 3 working days upon receiving our suggestion. We shall send you the RA code and authorised retailer’s address by email within 3 working days upon receiving your confirmation on the newly chosen Product for exchange. Alternatively, if you do not wish to choose from the suggested Products, please inform us to arrange for refund within 3 working days upon receiving our suggestion.

- The Product together with the Required Documents for Exchange must be returned to our authorised retailers within 7 working days upon receiving the RA code.

- We will not accept returns without Required Documents for Exchange (For gift purchase without a tax invoice, please contact customer services through cs@solvil-et-titus.co.th).

- Our authorised retailers will determine whether a returned Product is in its original condition (i.e. in the same condition as when originally purchased with all original packaging materials, accessories, unused warranty cards, instruction booklets and gift redemption) and our decision will be final.

- If you and our authorised retailer are unable to agree on the condition of the Product, our authorised retailer will fill in the Return Instruction Form and confirm our receipt of the Product. You are required to sign the Return Instruction Form to acknowledge the details stated in the Return Instruction Form. The returned Product will then be sent to us for inspection which will take 3 to 5 working days. Our decision will be final.

- If the Net Price per Unit of the Product exchanged is lower than the Net Price per Unit of the Product returned, the difference will not be refunded. If the Net Price per Unit of the Product exchanged is higher than the Net Price per Unit of the Product returned, the difference will be charged to you.

b. For exchange of Product by mail and at authorised retailer, the Product must be returned in its original condition and packaging (with all hanging tags, warranty card, spare parts, free gifts and gift redemptions, if any), and without any signs of damage, alteration or wear and tear. If a free gift and/or gift redemption item is not returned, additional charges will be applied. We are unable to exchange worn, sized or engraved watches.

c. For exchange of Product by mail and at authorised retailer, a Product can only be exchanged once.

2. Procedure for Exchange by Mail

a. Please read Terms of Exchange carefully before your exchange.

b. After receiving the RA code and address for return by email, wrap the package securely and return the Products together with the Required Documents for Exchange.

c. For your protection, ship your return via a traceable carrier, or a prepaid courier service. All the return shipping charges are to be borne by you. “Collect Charge” shipment will be refused.

d. Please insure your Product for its Net Price per Unit. We are not responsible for the damage or loss for returned Products that are not insured.

e. Send your return package to the address we provide when we give you the RA code. Please DO NOT return the Products to any address other than the ones stated in our email, or in our Web Site or we may not be able to trace the return shipment and we will not be responsible for the lost shipment in transit.

f. Once your returned package has been received by us, it is processed and inspected before we proceed in approving or disapproving the exchange. Upon receiving your Product, we shall send you an email within 7 working days informing you whether your request for exchange is accepted.

g. You are responsible for all taxes and duties and shipping costs for the new purchase Order.

3. Procedure for Exchange at our authorised retailers in Thailand

a. Please read Terms of Exchange carefully before your exchange.

b. After receiving the RA code, address of our authorised retailer and availability of your chosen Product, return the Products (in its original condition, see Terms of Return) together with the Required Documents for Exchange (For gift purchase without a tax invoice, please contact customer services through cs@solvil-et-titus.co.th)

c. Our authorised retailer will inspect the Products. Upon our inspection that the Products are in their original condition and without any signs of damage, alteration or wear and tear, we will arrange for an exchange of your chosen Product. If it is found that the Products do not fulfill the aforesaid conditions, your exchange will be rejected.

IX. PRODUCT WARRANTY

All Products sold by us are genuine. All Products are covered by a 2-year international warranty from the date of purchase.

The warranty does not cover bracelets, crystals, batteries, wear to the case or moisture damage (if the Product is non-water resistant), nor does it apply if there is evidence of misuse or abuse, including defects related to servicing not carried out by authorised dealers. Products damaged by wear and tear are not classed as a manufacturing defect.

During the warranty period, you may return the Product with postage prepaid or to our authorised retailers. You may view the list of authorised retailers at our Store Locator. If you cannot locate a service centre near you, you may return the Product to us for after sales services by contacting our customer services through email: cs@solvil-et-titus.co.th or phone (66) 02 984 0888 (the Product must be returned with postage prepaid). Please remember to send the Product accompanied with a valid warranty card.

In case of manufacturing defects covered by the warranty, we may arrange to refund, exchange the Product or repair the defective part. Exchange will be subject to stock availability.

X. OTHER SERVICES

1. Gift Packing

If you would like to have gift packing, please indicate in the “order notes” in the “Checkout details” page. To cater for your gift-giving needs, we will ship your purchase in a gift box/shopping bag. We will also hand write a personal message on a gift card at no extra cost.
